What This Warranty Covers
FireAvert, LLC solely warrants to the original retail purchaser of this product that the product, when used for its normal, proper, and intended purposes, is free of discernible manufacturing defects. This limited warranty, together with all warranties implied by law and not disclaimed by this limited warranty, if any, shall be limited to a period of one (1) year from the date of purchase by the original retail purchaser. This limited warranty is only valid as to the original retail purchaser and is not transferable or assignable by operation of law or otherwise.
What This Warranty Does Not Cover
This limited warranty does not cover abnormal use or misuse of the product, natural rust formation on any part of the product, or damage caused by accidents, alteration, mishandling, modification, customization, vandalism, negligence, neglect, abuse, abrasion, chemicals, flood, fire, acts of God, or ordinary wear and tear. Additionally, this limited warranty does not cover damages to the product from products not supplied by FireAvert or services by anyone other than FireAvert. Further, this limited warranty will not cover any damage caused from an improperly maintained product.
Acknowledgment of Limitations and Risks
You understand that no matter how careful you may be in installing, maintaining, and using the product, the risk of injury, illness, paralysis, death, and/or damage to person, property, or third parties is not eliminated. In particular, you acknowledge and understand that the manufacturer makes no guarantee or claim against the effectiveness of the product. You further acknowledge and understand that this product requires a working smoke alarm. Moreover, you acknowledge that there may be smoke damage until the product is triggered and until the smoke dissipates, that ambient noise, dirt, grease, dust, or other products may interfere with the product working properly. Per manufacture installation instructions, you understand that you must do a user test upon installing the product to confirm compatibility with your smoke alarm. You hereby waive any right you might otherwise have to warnings or instructions regarding any aspect of the product or any services utilized in connection therewith.
Your Rights if a Product is Defective and Covered Under this Limited Warranty
ALL WARRANTY CLAIMS WILL BE SUBJECT TO FIRE AVERT’S SOLE, ABSOLUTE, AND NON-REVIEWABLE DISCRETION AS TO WHETHER THE CLAIM IS COVERED BY THIS LIMITED WARRANTY. IF FIRE AVERT DETERMINES THAT YOUR WARRANTY CLAIM IS COVERED, YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY BREACH OF THIS LIMITED WARRANTY IS THE REPAIR OR REPLACEMENT OF THE DEFECTIVE PRODUCT (OR DEFECTIVE PORTION OF THE PRODUCT) AT FIRE AVERT’S COST. NO CASH REFUNDS WILL BE ISSUED FOR ANY BREACH OF THIS LIMITED WARRANTY.
Disclaimer of Other Warranties
THIS LIMITED WARRANTY REPLACES ALL OTHER WARRANTIES WHETHER EXPRESS OR IMPLIED. SPECIFICALLY, FIRE AVERT DOES NOT WARRANT THE MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR PERFORMANCE OF THE PRODUCT EXCEPT AS PROVIDED IN THIS LIMITED WARRANTY. FURTHER, FIRE AVERT DOES NOT WARRANT THAT THE PRODUCT WILL WORK FOR YOUR PARTICULAR CIRCUMSTANCES OR NEEDS. FIRE AVERT HAS NOT AUTHORIZED ANYONE TO MAKE ANY REPRESENTATION OR WARRANTY ABOUT THE PRODUCT EXCEPT AS PROVIDED BY THIS LIMITED WARRANTY, AND IS NOT RESPONSIBLE FOR ANY SUCH UNAUTHORIZED WARRANTIES MADE BY SUCH PERSONS.
Limits on Our Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, FIRE AVERT IS NOT LIABLE TO YOU OR ANY OTHER PERSON FOR INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES RELATED TO ANY DEFECTIVE PRODUCT, OR YOUR OR YOUR AGENT’S IMPROPER MAINTENANCE OR YOUR, YOUR AGENT’S, OR YOUR GUEST’S MISUSE OF ANY PRODUCT, OR ARISING FROM ANY CAUSE OF ACTION WHATSOEVER, INCLUDING CONTRACT, WARRANTY, STRICT LIABILITY, OR NEGLIGENCE, EVEN IF FIRE AVERT HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES, AND UNDER NO CIRCUMSTANCES WILL FIRE AVERT BE LIABLE TO YOU IN EXCESS OF THE AMOUNTS YOU PAID FOR THE PARTICULAR PRODUCT RELATED TO THE LIABILITY IN QUESTION.
How to Make a Claim
If you believe you have a claim covered under this limited warranty, please send Fire Avert a letter by mail or email to the address below containing your name, a copy of your purchase contract, and a description of the alleged defects in your product.
